The federal requirement arises from the Clean Water Act (CWA), particularly § 305(b) (state reports on water quality), § 303(d) (list of impaired waters), and § 314 (Clean Lakes Program). The state requirement arises from 38 Maine Revised Statutes (M.R.S.) § 464(3)(A) (report on the quality of the State's waters to the Maine Legislature). The Maine Department of Environmental Protection (The Department or DEP) assembles these reports with input from many sources, and recognizes that the § 305(b) Report and § 303(d) List are important ways of regularly communicating information on the health, current status and trends of the State’s waters.
